The Consumer Financial Protection Bureau has scaled back the data collection and reporting obligations that small business lenders must follow under the Equal Credit Opportunity Act. The revised rules aim to lighten the administrative load on smaller financial institutions while still maintaining fair lending oversight.
Under the original 2023 rule, lenders were required to gather and submit detailed information about small business loan applicants, including demographic data such as race, sex, and ethnicity. The CFPB's new adjustments narrow the scope of what must be reported and extend compliance deadlines for certain institutions. Community banks, credit unions, and other smaller lenders had argued that the initial requirements were overly burdensome and would drive up costs, potentially reducing access to credit for small businesses.
The bureau's decision follows months of feedback from industry groups and lawmakers who warned that the rules could hurt the very businesses they were meant to protect. By easing the reporting standards, the CFPB hopes to strike a balance between transparency and practicality. Critics, however, worry that the rollback could weaken efforts to detect discriminatory lending patterns. The changes take effect later this year, giving lenders time to adjust their systems and procedures.
